CHILDREN, YOUTH AND FAMILIES ACT 2005 - SECT 19A

Information use and disclosure for purposes of authorised functions and powers

    (1)     The Secretary may disclose information to a principal officer authorised under section 18 or 19 for the performance of a function or exercise of a power by that principal officer under the authorisation.

    (2)     The principal officer may disclose to the Secretary any information obtained by the principal officer in the course of performing functions or exercising powers under the authorisation, if the information is necessary for performance of those functions or exercise of those powers.

    (3)     The principal officer may disclose to any person any information obtained by the principal officer in the course of performing functions or exercising powers under the authorisation, if the principal officer reasonably believes that the information is necessary for performance of those functions or exercise of those powers.

    (4)     The Secretary may require the principal officer to give information to the Secretary obtained by the principal officer in the course of performing functions or exercising powers under the authorisation if the information is necessary to update records held by the Secretary relating to the performance of functions or exercise of powers in relation to a child who is the subject of the authorisation.
